Terms of Service

The Service is a web-based calculator that helps you estimate the financial performance of Florida rental property scenarios using figures that you enter. It produces estimates and printable reports based on your inputs and our assumptions. It does not verify any data you enter and does not obtain data from any authoritative source on your behalf.

Subject to these Terms and your payment of the applicable one-time fee, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal or internal business real estate analysis. All software, content, layout, formulas and reports remain our property or that of our licensors.

Full access to the Service is a one-time purchase of $39 (USD), not a subscription. Payment is processed by Stripe. Access is granted to the account that completed the purchase after our server verifies the payment. Refunds are governed by our Refund Policy.

You must provide accurate registration information and keep your password confidential. You are responsible for all activity occurring under your account. Accounts are for a single user; do not share credentials. Notify us promptly at maurice@premierpropertyvolusia.com if you believe your account has been accessed without your authorization.

You agree not to:

• resell, rent, sublicense, share, or otherwise commercially redistribute access to the Service;
• copy, reverse engineer, decompile, disassemble, scrape, or attempt to derive the source code, formulas or underlying models of the Service, except where such restriction is prohibited by law;
• use bots, scrapers, or automated means to access the Service or create accounts;
• circumvent or attempt to circumvent authentication, payment, access controls, or usage limits;
• upload unlawful, infringing, or malicious content, or interfere with the operation or security of the Service;
• use the Service to provide a substantially similar analysis product or service to third parties.

All outputs of the Service are estimates provided for informational purposes only. The Service is not financial, investment, legal, tax, accounting, insurance, appraisal, or other professional advice, and no fiduciary or advisory relationship is created by your use of it. You are solely responsible for independently verifying rents, expenses, insurance and flood costs, property taxes and reassessment, HOA and condominium matters, financing terms, property condition, applicable laws, and the suitability of any investment. We do not guarantee the accuracy or completeness of any calculation, estimate, or report, and we do not guarantee any level of cash flow, appreciation, occupancy, return, or other investment outcome. Decisions you make using the Service are made at your own risk.

You retain ownership of the property data and analyses you enter. You grant us the limited right to store, process and display that data solely to operate the Service for you. You are responsible for keeping your own copies of anything you need to retain.

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance, updates, or events outside our control. We may modify, improve, or discontinue features at any time. If we permanently discontinue the Service entirely, we will use reasonable efforts to give advance notice so you can export or print your analyses.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST INVESTMENT RETURNS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Premier Property Group of Volusia County, LLC and its members, officers and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law or the rights of a third party.

You may stop using the Service at any time and may request account deletion by emailing us. We may suspend or terminate your account and license, with or without notice, for violation of these Terms, abuse of the Service, fraud, chargeback abuse, or unlawful use. Sections that by their nature should survive termination will survive.

We may update these Terms from time to time. The effective date above reflects the most recent version. Material changes will be posted on this page; continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. The exclusive venue for any dispute is the state or federal courts located in Volusia County, Florida, and you consent to personal jurisdiction there.
